Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of Song Cage, a web-based songwriting application available at app.songcage.com. Song Cage is operated by Digital Candy LLC.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Song Cage.

Accounts

To use Song Cage, you must create an account. You can sign up using an email address and password, or authenticate through Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must provide accurate information when creating your account. You must be at least 13 years of age to use Song Cage. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

Subscription Tiers

Song Cage offers three subscription tiers:

Payment & Billing

All payments are securely processed by Stripe. Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled. You can manage your subscription and cancel at any time through the Stripe customer portal, accessible from your account settings.

Prices are listed in US Dollars. Applicable taxes may be added at checkout based on your location.

Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will continue to have access to paid features until then. We do not offer partial refunds for unused time within a billing period.

If your subscription is cancelled or expires, your account will revert to the Free tier. Your songs will remain in your account, but you will be limited to the features available on the Free plan.

Your Content

You own your content. Songs, lyrics, chord progressions, audio recordings, and any other content you create using Song Cage remain entirely yours. Digital Candy LLC claims no ownership, intellectual property rights, or license to your user-created content beyond what is necessary to operate the Service (such as storing and displaying your content to you and any collaborators you invite).

You may export or delete your content at any time. If you delete your account, your content will be permanently removed from our systems within 30 days.

Acceptable Use

You agree not to use Song Cage to:

• Upload, store, or share content that is illegal, infringing, or violates the rights of others
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Use automated systems (bots, scrapers) to access the Service without permission
• Use the Service for any purpose that violates applicable law

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

Service Availability

Song Cage is provided on an "as is" and "as available" basis. We strive to maintain high availability, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users in advance of significant changes.

Limitation of Liability

To the maximum extent permitted by applicable law, Digital Candy LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of Song Cage.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability.

Disclaimer of Warranties

The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or expectations.

Modifications to These Terms

We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date at the top of this page. For significant changes, we may also notify you via email or through the Service.

Your continued use of Song Cage after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should discontinue use of the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which Digital Candy LLC is registered, without regard to its conflict of law provisions.
